Section 38(1)(b) of the Freedom of Information (Scotland) Act 2002 has been applied to third party personal data, i.e. to names and contact details of individual staff members, members of the public and former employees which have been redacted as disclosure of this information would then contravene Article 5(1)(a) of the GDPR, where personal data shall be processed lawfully, fairly and in a transparent manner in relation to the data subject. There is no expectation that staff would have their names and contact details released into the public domain.
